These Terms of Service (“Terms”) govern your relationship with Privy Domains GmbH (“Privy Domains,” “we,” “us”) when you use privydomains.com, create an account, register or transfer domain names, purchase add-ons such as WHOIS privacy or DNS services where offered, and interact with our support channels. By ordering services, you confirm that you have authority to bind yourself or your organization and that you accept these Terms together with registry rules, registrar accreditation requirements, and—where applicable—ICANN policies incorporated by reference.
1. Scope of services
Privy Domains provides retail domain registration, renewal, transfer, and portfolio management features as described on our website and order paths. We act as an intermediary toward registries and registry operators. Successful registration always depends on registry availability, technical checks, and policy compliance. We may refuse orders that appear fraudulent, abusive, or contrary to applicable law or registry terms.
2. Accounts, identity, and security
You must supply accurate registrant, administrative, and billing data and keep it current. You are responsible for safeguarding credentials, enabling multi-factor authentication where available, and promptly notifying us of unauthorized use. Activity performed through your authenticated session is attributed to you unless you demonstrate compromise despite reasonable security hygiene.
3. Domain registrations and renewals
Domain names are licensed for fixed terms. Renewal fees must be received before the expiration date unless auto-renewal succeeds with a valid payment method. We may send reminders but you remain responsible for renewal timing. Failure to renew can result in deletion, redemption fees, or loss of the name to third parties per registry rules. Registration does not confer trademark rights; you warrant that your registrations do not infringe third-party intellectual property or personality rights.
4. Pricing, taxes, and chargebacks
Prices displayed are generally exclusive of applicable taxes unless stated otherwise. We may adjust list prices prospectively; existing terms for prepaid periods remain unaffected. Chargebacks or payment reversals may lead to immediate suspension of services and recovery of registry fees we advanced on your behalf.
5. Acceptable use
You may not use our services for unlawful conduct, phishing, malware distribution, botnet command-and-control, spam in violation of law, child exploitation material, or activities that violate sanctions. We may suspend, lock, or cancel services when required by law, court order, trusted notifier programs, or credible abuse reports, and may cooperate with registries and law enforcement as permitted by law.
6. WHOIS, privacy services, and disclosure
WHOIS accuracy obligations apply under ICANN and registry policies. Privacy or proxy services, if offered, mask certain fields in public directories but do not eliminate legal duties to respond to legitimate disclosure requests. We may reveal data when required by court order, subpoena, or enforceable governmental demand, or when necessary to protect rights and safety.
7. DNS, nameservers, and technical services
Where we provide DNS hosting or forwarding, uptime targets and support scope are defined in the product description or separate SLA. You remain responsible for correct DNS records, DNSSEC configuration choices, and propagation delays outside our control.
8. Transfers and locks
Transfers follow ICANN’s Inter-Registrar Transfer Policy and registry-specific rules, including potential 60-day locks after initial registration or certain status changes. You must ensure auth codes and unlock requests are handled securely. We are not liable for delays caused by losing registrars or registry maintenance windows.
9. Dispute resolution
Domain name disputes are subject to UDRP, URS, or national procedures where applicable. Nothing in these Terms prevents registries from taking policy actions independent of the registrar.
10. Intellectual property and branding
Our website, documentation, and trademarks remain our property. You receive no license beyond what is necessary to use the services. You grant us a limited license to use your marks on invoices and support correspondence related to your account.
11. Limitation of liability
To the extent permitted by German and applicable law, our aggregate liability arising from these Terms or the services in any twelve-month period is limited to the fees you paid for the affected domain(s) or service line, except in cases of intentional misconduct, gross negligence, injury to life, body, or health, or liability under mandatory product safety rules. We are not liable for lost profits, goodwill, or consequential damages except where such exclusion is void.
12. Indemnity
You will indemnify Privy Domains against third-party claims, fines, and reasonable defense costs arising from your domain usage, content pointed to your nameservers, or false registration data you supplied.
13. Termination
We may terminate or suspend services for material breach, non-payment, or legal compulsion. You may terminate according to product rules; some registry fees are non-refundable once submitted.

15. Governing law and venue
These Terms are governed by the laws of the Federal Republic of Germany. If you are a merchant, legal entity under public law, or special fund under public law, exclusive venue is Munich, Germany. Consumer mandatory rights remain unaffected where applicable.
16. Changes
We may update these Terms with reasonable notice where required. Continued use after the effective date may constitute acceptance unless you are a consumer with statutory withdrawal or objection rights.
